By creating an account or using the Service, you ("User" or "you") agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Service Description

- Connect third-party services (CRM systems, messaging platforms, marketplaces, and others) through pre-built connectors.
- Execute, monitor, and manage automated workflows.
- Access conversational AI assistance for building and managing business automations.
The Service is provided as a software-as-a-service (SaaS) on a non-exclusive, non-transferable license basis for the duration of the applicable Subscription Plan.
4. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with third parties.
- Notify us immediately of any unauthorized use of your account.

5.4 Refund Policy
If you are not satisfied with the Service, you may request a full refund within 14 days of your initial paid subscription or of an upgrade to a higher-tier plan. Refund requests should be sent to legal@usetriggo.com.
5.5 Non-Payment
If payment fails, we will notify you and provide a 90-day grace period. During this period, your account may be downgraded to the free tier. After the grace period, your data may be subject to deletion in accordance with section 10.

7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its design, source code, AI models, documentation, connectors, and all related materials, is owned by Triggo and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
7.2 Your Content
You retain all rights to your User Content, including your data, pipeline configurations, and integration settings. By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service.
8. AI-Generated Content Disclaimer

- AI-generated pipelines and recommendations are provided "as-is" without any guarantee of accuracy, completeness, or fitness for a particular purpose.
- You are solely responsible for reviewing, testing, and validating all AI-generated workflows before activating them in a production environment.

- We do not guarantee that AI-generated pipelines will achieve any specific business outcome.
9. Service Availability
We aim to maintain a monthly uptime target of 99.5% for the Service. This is a target, not a guarantee.
We reserve the right to perform scheduled maintenance, during which the Service may be temporarily unavailable. We will provide at least 24 hours' notice for planned maintenance where reasonably possible.
We are not liable for any downtime, interruptions, or data loss resulting from circumstances beyond our reasonable control, including but not limited to failures of third-party services, network outages, or force majeure events.

You may export your User Content at any time through the Service. We recommend regularly exporting important data.

10.3 Termination by Triggo
We may suspend or terminate your account if you violate these Terms. Except in cases involving security threats or illegal activity, we will provide 7 days' written notice before termination and an opportunity to remedy the violation.
10.4 Service Discontinuation
If we decide to discontinue the Service, we will provide at least 60 days' notice and allow you to export your data before the Service is shut down.
10.5 Data Retention After Termination
After account termination or deletion, we will retain your data for 30 days to allow for recovery. After this period, your data will be permanently and irreversibly deleted from our systems, except where retention is required by law.
11. Limitation of Liability

- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount of fees paid by you during the three (3) months immediately preceding the event giving rise to the claim.
- We are not liable for any actions, errors, or omissions of third-party services connected through Triggo, or for any data processing performed by those services.
Nothing in these Terms shall limit our liability for fraud, gross negligence, or any liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold Triggo harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws applicable in the European Union.
Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, either party may submit the dispute to the competent courts or arbitration in accordance with applicable law.
